Litigating a case on appeal is fundamentally different from trying the matter to a judge or jury. Many lawyers simply attempt to
"retry the facts" on appeal. They fail to comb through the myriad of disputes and issues decided by the judge or jury to
find the few discrete, clear legal issues that can overturn or sustain the trial court’s decision. Our appellate experience,
